1. Overview
The McCance Method Inc. operating under the name “ClinicMonkTM” (“ClinicMonk™,” “we,” “us,” and “our”) respects your privacy and is committed to protecting it through compliance with this Privacy Policy (“Privacy Policy”). This Privacy Policy describes how we collect and use your Personal Information when you visit our website at https://clinicmonk.com (the “Site”), except as specified below with respect to our role as a processor.
PLEASE READ THIS PRIVACY POLICY CAREFULLY. By using our Site otherwise by choosing to provide us with your Personal Information, you acknowledge and consent to the processing of your Personal Information in accordance with this Privacy Policy and as may be further identified when the Personal Information is collected.
This Privacy Policy does not apply to data subjects of our customers whose Personal Information we may receive through ClinicMonk™ services we provide to our customers (such as clinics). Our customers use our platform to store and process their own customers’ and clients’ Personal Information, such as to: (i) manage leads, inquiries, referrals, and consult requests; (ii) communicate with prospective clients and contacts via email, SMS, phone, and other communication tools; (iii) track and organize lead status, follow-ups, and conversion activity; (iv) automate administrative workflows, reminders, and marketing communications for their clinic or practice; (v) offer or provide their own materials; or (vi) otherwise collect, use, share or process Personal Information. In these cases, we act as a processor and service provider when providing these services to our customers (the “Processor Services”).
NOTE: When you give your data to one of our customers or when we collect your Personal Information on their behalf in connection with our Processor Services, our customer’s privacy policy, rather than this Privacy Policy, will apply to our processing of your Personal Information.
Please read this Privacy Policy to understand our policies and practices regarding your Personal Information and how we will handle it. If you do not agree with our policies and practices, do not use the Site. By accessing or using the Site, you agree and consent to this Privacy Policy.
2. Information That ClinicMonk™ Collects About You
For the purposes of this Privacy Policy, "Personal Information" means any information about an individual or any information that can be used, either alone or in combination with other information, to identify an individual. This Privacy Policy does not impose any limits on the collection, use, or disclosure of business contact information or certain publicly-available information.
We collect information about you:
- Directly from you when you provide it to us. When you subscribe to a newsletter, create an account, make a purchase or request information from ClinicMonk™ through the Site, we will ask for things like your name, contact (including email address and phone number), billing, communication information, and account ID or credentials in order to fulfill your request. If you contact us through the Site you may also provide similar information. If you submit any Personal Information about other people to us or to our service providers, you are responsible for making sure that you have the authority to do so and to allow us to use their Personal Information in accordance with this Privacy Policy (for example, by you obtaining their consent).
- From third parties. We obtain information through marketing partners (such as advertising and marketing companies, marketing affiliates, and social media platforms), vendors (such as data set and information vendors), and suppliers and other third parties (such as hosts or vendors at events or trade shows, public database providers, or research partners). This information can include, for example, your name, contact information, professional information, and content that is publicly available. We might also obtain information through a partner, or co-create datasets with a partner, as part of our business operations.
- Automatically when you use our Site. We collect information about how you interact with the Site including information about your device (such as IP address and other technical information about your device), the actions you take on our Site, and through the use of cookies, pixel tags, and similar technologies (collectively, “cookies”). 3. How ClinicMonk™ Uses Information It Collects About You
We use Personal Information that we collect about you or that you provide to us for the following purposes (collectively, the “Purposes”), and as otherwise permitted or required by applicable law:
- For Functionality and Development of the Site. We use information to provide, offer, personalize, and improve the Site. Some information, like your IP address, is used to communicate with your device to provide network connectivity, measure usage levels of the Site, diagnose server problems and provide security features. Other business purposes that depend on use of your information include data analysis related to testing, modifying, improving or developing new products, services and technologies, and to identify trends. We also use information from the Site to generate updates and reports, and to check that the Site is working properly. Update functions may automatically check your system to see whether files need to be refreshed, updated, or modernized, in order to provide you with the up-to-date security, versions, features, options and controls associated with your systems or devices. We use cookies to make our websites and the Site operate, work more efficiently, and provide analytic information, as explained further below.
- To Provide AI Features: Some Site features may leverage artificial intelligence (“AI”) tools to enhance performance capabilities. Our use of AI is designed to provide direct services to you. We do not use your Personal Information to train generalized, public AI models. We work with specialized AI subprocessors and our instructions limit their use of your data to the provision of the specific service you are using.
- For Customer Support. We use your Personal Information to provide you with customer support for the Site.

- To Communicate. If we learn, for example, of heightened interest in certain aspects of the Site, we are likely to highlight that information on the Site home page. This Information helps us create a better overall experience for Site users.
- For Legal, Regulatory, and Compliance Purposes. We may use Personal Information to comply with legal, regulatory, or related obligations, including to protect our legal rights.

The form of consent may vary depending on the circumstances and the type of information being requested. Your consent may be express with clear options to say "yes" or "no", such as by being asked to check a box to indicate your consent, or implied, such as when you provide us with your address through a form or email seeking information so that we can use those means to respond to your request. Your consent can also be provided by your authorized representative.
By using our Site or services or otherwise by choosing to provide us with your Personal Information, you acknowledge and consent to the processing of your Personal Information in accordance with this Privacy Policy and as may be further identified when the Personal Information is collected.
When we process your Personal Information for a new purpose, we will disclose that the new purpose to you before that use, and we will seek your consent unless the use is authorized or required by law

If you notify us that you withdraw consent, we will inform you of the likely consequences of that withdrawal of consent, which may include our inability to provide certain services for which that information is necessary. Any withdrawal of consent will not affect the lawfulness of any processing up until that withdrawal.
Any material, information, or other communication (including questions, comments, and suggestions) you transmit to us through our website will be considered non-confidential and non-proprietary.
5. Cookies, Tracking and Site Analytics
We and our third-party providers may use cookies, local shared objects, and other tracking technologies (referred to herein as “cookies”) to collect browsing, activity, device and similar usage information within our Site.

6. How ClinicMonk™ Protects Your Information
We design our Site to provide reasonable and appropriate administrative, technical and organizational security measures to protect your Personal Information against risks such as temporary or permanent loss, destruction, and unauthorized or unlawful access, alteration, use or disclosure. We will take reasonable measures, through contractual or other reasonable means, to ensure that a comparable level of personal information protection is implemented by the suppliers and agents who assist in providing services.
Site users must also do their part in protecting the data, systems, networks, and service they are using. No technology, data transmission or system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that your password to any ClinicMonk™ account has been compromised), please immediately notify us by contacting us using the instructions in the “How To Contact Us” section below.
7. When ClinicMonk™ Shares Your Information
We may share Personal Information with the following categories of third parties:
- With Affiliates and Subsidiaries. We may share information with our corporate affiliates and subsidiaries for purposes described in this Privacy Policy.
- With Service Providers. We may share information with our authorized vendors and suppliers to provide services we have contracted for, such as product delivery, website hosting, data analysis, IT services, auditing, or customer service. We use a wide variety of software and tools, and we process Personal Information using these tools as a regular course of business.
- With Partners. We work with third parties for purposes such as marketing and similar promotions, to enable joint products or identify opportunities for product integration, or to facilitate services on the Site.
- For Advertising and Marketing. We share your information with our third-party company partners to prepare and deliver advertising and marketing content, to provide content services and to enable them to provide you with more personalized ads and to study the effectiveness of our campaigns.

For example, if you choose to connect your Google or other third-party account to the ClinicMonk™ services, this connection uses the respective third party’s API services, and their privacy policy will apply to you. If you have authorized us to access your information via third-party API services, in addition to our normal procedure for deleting stored data, you may revoke our access to your data via the applicable third party’s security settings.
- Sales, Mergers & Acquisitions. We may disclose Personal Information as part of a contemplated or actual corporate transaction such as a reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings).
- For Legal, Regulatory, or Related Purposes. We may disclose your information to the extent required or permitted by law or if we have a good-faith belief that such disclosure is necessary in order to comply with official investigations or legal proceedings initiated by governmental and/or law enforcement officials, or private parties, including in response to subpoenas, search warrants, or court orders.
- At Your Direction or With Your Consent. We may disclose your Personal Information to any other person or entity where you consent to the disclosure or otherwise direct us to disclose the information.
8. Requests for Access to and Correction of Personal Information
Applicable privacy laws may provide you with specific statutory rights, including, for example, the right to access or request the correction of errors or omissions in your Personal Information that is in our custody or under our control. You may request access to and review of your Personal Information in our possession. However, we may decline access where permitted or required by applicable law.
You may request that we correct your Personal Information in our possession or control. We reserve the right not to change any Personal Information if we do not agree that it is inaccurate or outdated, but will append any alternative text the individual concerned believes appropriate.
If a rights request cannot be met, we will notify the individual making the request within 30 calendar days, in writing, of the reasons for the refusal and we will create a record that a correction was requested but not made.
9. Retention of Your Personal Information
We generally keep Personal Information for only as long as it is needed to accomplish the Purposes for which it was collected, or as needed for authorized or legitimate or legally required purposes. More specifically, we retain Personal Information as long as necessary for the fulfillment of the identified Purposes for its collection or as otherwise necessary to comply with applicable laws or protect our interests.
When Personal Information is no longer necessary or relevant for the identified Purposes, or is no longer required to be retained by applicable laws, we will take steps to have it deleted, destroyed, erased, aggregated, or made anonymous. We use reasonable industry practices to ensure that we have adequate controls, schedules, and practices for information and records retention and destruction which apply to Personal Information.
10. Information From Minors
We do not knowingly collect, use, disclose, sell, or share Personal Information from minors (individuals under the age of majority in their jurisdiction, which in Canada is 18 or 19 depending on the province or territory). If we learn that we have collected the Personal Information of a minor we will take steps to delete the information as soon as possible. If you are a minor, do not provide any information about yourself to ClinicMonk™. If you become aware that Personal Information of a minor has been provided, please let us know using one of the methods provided under the “How To Contact Us” section below.
11. Links to Other Websites and Services
We are not responsible for the practices employed by websites or services linked to or from the Site, including the information or content contained in any such site or service. This Privacy Policy does not address, and we are not responsible for, the policies and practices of third parties or other organizations, including policies and practices related to privacy and security, data collection, processing, use, storage, and disclosure. This includes: (a) any third party operating any site or service to which the Site links – the inclusion of a link on the Site does not imply endorsement of the linked site or service by us or by our affiliates; or (b) any app developer, app provider, social media platform provider, operating system provider, wireless service provider or device manufacturer (such as Facebook, Apple, Google, Microsoft, LinkedIn, etc.) – including any Personal Information you disclose to other organizations through or in connection with the Site or other ClinicMonk™ services.
We have no responsibility or liability for, or control over, those third-party services or their collection, use, and disclosure of your Personal Information. We encourage you to read the privacy policies of those third-party services to learn how they collect and use your Personal Information.
12. International Data Transfers
We operate an online Site and has various affiliates and service providers throughout the world. As such, we may transfer your Personal Information between Canada and our affiliates and service providers in other jurisdictions (who may be located in a different jurisdiction to you).
Applicable laws in those other jurisdictions might permit foreign governments, courts, law enforcement or regulatory agencies to access the information in those jurisdictions. In these cases, we will comply with applicable local law requirements relating to the conditions for disclosure or release of personal information.
